Data Protection and Privacy Policy
Introduction
HiBizCloud is a cloud based business management software brought to you by Honsoft Technology Centre Ltd (“HONSOFT”). Honsoft is committed to protecting the privacy of individuals who visit hibizcloud.com (“Visitors”), and the individuals who register to use the Services as defined below (“Customers”). This Privacy Policy describes our privacy practices in relation to the use of hibizcloud.com and the related web and mobile applications and other services offered (collectively, the “Services”).
Honsoft recognizes that handling personal data appropriately is critical and has adopted appropriate data systems, privacy, and security measures to ensure that it shall not knowingly violate the rights of data subjects through its processing and handling of data.
Honsoft values and respects the privacy of the people we deal with, committed to protecting your privacy and other applicable privacy laws and regulations.
Policy Statement
Honsoft has a responsibility to protect confidential, restricted, and/or sensitive data from unwarranted disclosure, loss, or damage to avoid adversely affecting our staff and stakeholders from whom we collect data. Handling personal data in an ethical manner is in line with Honsoft and will apply all necessary resources to ensure that the rights of individuals are protected. This Privacy Policy describes how we collect, hold, use and disclose your personal information, and how we maintain the quality and security of your personal information.
Guiding Principles
Honsoft will adhere to the principles for processing personal data as set out in various Kenyan and international laws and regulations and relate to data subjects and data from other Honsoft stakeholders. These principles include:
Privacy: Honsoft recognizes the right of a data subject to have control over how his or her personal data is collected, used, and/or disclosed.
Confidentiality: Honsoft will take reasonable measures to ensure that data in its possession is kept safe and only accessed by authorized individuals.
Integrity: The Honsoft will maintain accurate records and where required, take necessary steps in providing the assurance of data accuracy and consistency of data in its possession.
Autonomy: Honsoft recognizes and protects the rights of data subjects to make informed decisions about when to have their data collected and for what it may be used for.
Beneficence and maleficence: Honsoft will process its data in a responsible way and will not knowingly process data in a way that causes harm to data subjects.
Justice: Honsoft will process all data that is in its possession lawfully, fairly, and in a transparent manner. In this regard, Honsoft will collect personal data for specified, explicit, and legitimate purposes.
What we mean by personal Information
“Personal information” means any information relating to an identified or identifiable natural person. In general terms, this includes information or an opinion that personally identifies you either directly (e.g. your name) or indirectly.
What data we collect
When contacting us, scheduling a demo, signing up for a free trial, or subscribing to use the Services, Honsoft requires you to provide us with personal contact information, such as name, company name, address, phone number, and email address (“Required Contact Information”). When purchasing the Services Honsoft may also require you to provide billing information, such as billing name and address, credit card number (“Billing Information”). This Billing Information and any other information you submit to Miles or submit through the Services are referred to collectively as “Data.”
If we collect your sensitive information, we will do so only with your consent, if it is necessary to prevent a serious and imminent threat to life or health, or as otherwise required or authorised by law, and we take appropriate measures to protect the security of this information.
How we use your personal information
Honsoft uses Data about its Customers to perform the services requested. For example, if you fill out the “Try It Free” form, Honsoft will use the information provided to set up the system for the trial and to contact you about your interest in the Services.
Honsoft may also use Data about its Customers for marketing purposes such as sending you information regarding the Services.
Honsoft may access Customer Data only for the purpose of providing or maintaining the Services or addressing service or technical problems or as may be required by law. Honsoft’s Customers can export Customer Data by utilizing export functionality within the Services at any time during the term of their subscription.
We use personal information for many purposes in connection with our functions and activities, including the following purposes:
- provide you with information or services that you request from us;
- deliver to you a more personalised experience and service offering;
- improve the quality of the services we offer;

Disclosure of personal information to third parties
We will not sale, trade or transfer any of your data to any third party for business or illegal activities. We may disclose your personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect us to disclose your information. For example, we may disclose your personal information to:
- our third party service providers (for hosting your services);
- our third party service providers (for your bulk sms services);
- our third party service providers (for your payments integration);
- our professional services advisors;
Transfer of Personal Data Overseas
Some of the third-party service providers we disclose personal information to may be based in or have servers located outside of Kenya, including in Germany, France and United Kingdom. Where we disclose your personal information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained.
We will only disclose to overseas third parties if:
- you have given us your consent to disclose personal information to that third party; or
- we reasonably believe that: the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the APPs;
How we protect your personal information
Honsoft will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure, including by:
- using password protected directories and databases;
- using SSL (Secure Socket Layer) to ensure that your data sent across the Internet is fully encrypted.
- taking measures to restrict access to only personnel who need that personal information to effectively provide services to you;
- having technological measures in place (for example, anti-virus software, fire walls);
Changes to This Privacy Policy
Honsoft reserves the right to change this Privacy Policy. Material changes to this Privacy Policy will be communicated through our official website www.honsoftcentre.co.ke at least thirty (30) business days prior to the change taking effect.
